Weeklong Hearing Scheduled For Proposed Transmission Line

People who filed to intervene in the case and may appear to testify have been warned to be present and ready to speak at the start of their scheduled day at 9:30 a.m. or risk losing their opportunity to speak.

State officials have released the plan for a marathon hearing over a proposed power line that will cross four West Virginia counties.  

The Public Service Commission of West Virginia issued a scheduling order Wednesday to organize a weeklong hearing into the case of the MidAtlantic Resiliency Link (MARL).  

Developer NextEra Energy applied Jan. 30 to construct a new 107.5-mile-long transmission line from Pennsylvania through West Virginia to Virginia. Public comment sessions were held in all four of the affected counties of Monongalia, Preston, Mineral and Hampshire in June. The commission set regulatory hearing dates for late October and early November, with deadline to file direct testimony by Sept. 8.         

Back in March the hearing dates were set for Oct. 26-30 and Nov. 2 at the PSC headquarters in Charleston. The commission has now decided to allocate the first two and a half days primarily for the presentation and cross-examination of the expected 10 witnesses from developer NextEra.  

The commission also established a daily schedule for the testimony of the approximately 64 persons who filed to intervene in the case and may appear to testify.  

“Witnesses scheduled for a particular day shall be present and available to testify at the beginning of the day. Because of the large number of scheduled witnesses, the commission intends to proceed continuously by calling witnesses consecutively as the preceding witness completes their testimony,” the scheduling order states. “The commission will not delay the proceeding to accommodate a witness who is unavailable during the session for which the witness has been scheduled. Given the number of scheduled witnesses and the rights of parties to cross-examine witnesses, the commission will not ordinarily reschedule witnesses who fail to appear when called.” 

The scheduling order also asks parties to identify in advance the witnesses they anticipate to cross-examine. 

Recognizing the difficulty of even interveners and other interested parties to attend all six days in person, the commission will livestream the proceeding to allow parties and members of the public to observe the proceeding remotely. 

Commission staff reviewing the transmission line application recommended in August the application be delayed by at least 60 days or dismissed entirely. A commission staff engineer who provided testimony in September that the MARL project is not needed is scheduled to be the final speaker Nov. 2.
