Court Rules W.Va. Medicaid Not Required To Pay For Gender-Affirming Care

The Fourth Circuit Court of Appeals reversed a lower court ruling and held that West Virginia’s policy to deny gender-affirming care does not violate the Equal Protection Clause, the Affordable Care Act or the Medicaid Act.

W.Va. Gender-Affirming Surgery Case Kicked Back To Lower Court

The Supreme Court vacated a decision by the Fourth U.S. Circuit Court of Appeals last year that the state’s exclusion of gender-affirming surgery under Medicaid violated federal law.
