University Board Of Governors Makes Way For Concealed Carry On Campus

West Virginia’s colleges and universities will be required by a new law to allow students to carry concealed deadly weapons on campus starting July 1. 

In March, Gov.  Jim Justice signed the Campus Self-Defense Act into law. It allows, with some exceptions, anyone with a permit to concealed carry on the campus of any public institution of higher education. 

On April 12, WVU’s Board of Governors approved a rule initiated by the law. Handheld guns like revolvers and pistols will be allowed on campus and must be concealed and carried by a person licensed to do so. 

Concealed Carry will still not be allowed at many places on campus including most university stadiums or arenas, daycares, some health care facilities, and anywhere on campus where possession of a firearm is prohibited by state law. 

For non-employees, handheld firearms will still be banned from dorms but will be allowed in common areas.

The law will take effect on July 1. A webinar is scheduled for Thursday to update students, faculty and staff on the implementation of this rule. 

Updated to reflect that it requires a concealed carry permit to carry on campus.

Senate Changes, Passes Bill To Reduce Unemployment Benefits 

The engrossed bill that passed the Senate shaves two weeks of the current 26 weeks of unemployment benefits available to workers who have lost their job due through no fault of their own. It increases the initial benefit to up to $712 per week, or 70 percent of the original wage, for the first four weeks of unemployment. That’s up from $624 per week, and 65 percent of the wage. However after those first four weeks, the benefit decreases by 5 percent of the original wage, or max benefit.

The Senate passed a bill that would reduce overall unemployment benefits but increase initial benefits.

Senate Bills 840 and 841 would have steeply cut unemployment benefits. Those bills were combined and amended- and for the most part gutted with a new amendment. 

The amended bill that passed the Senate shaves two weeks off of the current 26 weeks of unemployment benefits available to workers who have lost their job due through no fault of their own. The bill would also allow people to work part time while receiving unemployment. They would receive reduced benefits while working. 

Under this amended bill the benefits are front loaded, and taper off as time goes on. It increases the initial benefit to up to $712 per week, or 70 percent of the original wage, for the first four weeks of unemployment. That’s up from $624 per week, and 65 percent of the wage. However after those first four weeks, the benefit decreases by 5 percent of the original wage, or max benefit. 

For example, on week five, the benefit would be 65 percent, and on the ninth week it would be 60 percent. On week 20 through week 24, the last weeks of the available benefit, unemployed people would receive 45 percent of their original benefit. 

The West Virginia Center on Budget and Policy said that the average time an unemployed person collects benefits in the state is 13 weeks. 

Sen. Eric Nelson, R-Kanawha, said that this bill would benefit the average unemployed person, because they would collect that initial larger benefit. 

The bill also requires that employers contribute more to the unemployment insurance fund. 

“The average wage of those on the unemployed base is roughly $35,000,” Nelson said. “And so currently, over that 14 week period, they would receive $5,166. Under the proposed method, they would receive $5,991 to an increase of $800.” 

However, Josh Sword, West Virginia AFL-CIO president, said the bill would cost some West Virginians who use the full duration of the benefit thousands of dollars in unemployment benefits. 

“As it stands now, compared to the bill that was adopted in the Senate last night,” Sword said. “We know that individuals are going to receive about $4,000 less in benefits than they would today. So that’s concerning.” 

The original bills would have reduced the maximum benefit to  $550 per week and reduced the duration based on the current unemployment rate. It would reduce the benefits duration down to 12 weeks based on the current unemployment rate of 4.3 percent. 

The 28 page amendment, which significantly changed the bill, was introduced on the floor 30 minutes before the bill was voted on. 

Sen. Mike Caputo, D-Marion, said he understands the need for the bill but wanted more time to work out the details and bring stakeholders like business and labor unions to the table to talk about the bill. 

“Don’t think it should be done in the 11th hour. I think it’s bad, bad government to do this,” Caputo said. 

He said this sends a horrible message to the working people of West Virginia and the nearly 2,000 people who are slated to lose their jobs from layoffs from the closures of Allegany Woods and Cleveland Cliffs. 

Sword agreed, and said he would have liked the AFL-CIO to have been involved in the drafting of legislation that would affect workers in the state. 

“The best way to get good policy is to bring all impacted parties to the table,” Sword said. “And come up with a good common sense solution that makes sense for everybody. That absolutely did not happen. And that’s part of the reason that we don’t know what’s in it because we weren’t at the table trying to put something together.” 

Nelson says the bill, that was put together privately over the course of three days, does include a few errors. 

“One of the unfortunate things that does happen when we’re here at this speed at the end. This is not a final product, this goes over to the house. There’ll be additional discussions, and I’m gonna have more discussions with Senator Caputo and labor and others because we want the best product going forward. And that’s what we have,” Nelson said.

Federal Student Loan Forgiveness Means Millions For W.Va. Borrowers

Over a thousand West Virginians will have $8.8 million in student loans canceled.

On Wednesday the Biden administration announced $1.2 billion in student debt cancellation for almost 153,000 borrowers. New data released Friday shows the effects on West Virginia.

Over a thousand West Virginians will have $8.8 million in student loans canceled. Texas leads the nation with more than 14,000 recipients having $116.6 million in student loans forgiven, while Wyoming had the lowest amount of forgiveness with 150 borrowers having $1 million canceled.

Kirabo Jackson, a member of the Council of Economic Advisers, said this round of loan forgiveness is for borrowers enrolled in the Saving on a Valuable Education or SAVE repayment plan that have been in repayment for 10 years and took out $12,000 or less in student loans.

“In order to ensure that the burden of college debt does not reduce the benefits of having a college degree, the Biden administration has basically rolled out this new income driven repayment plan called SAVE,” he said. 

Jackson said the program ties the payments that people make to their income levels and family size, not to the size of the loan itself. 

“It means that early in someone’s career, when they’re not making a lot of money, their payments are going to be relatively low,” he said. “In fact, they can actually be zero, if their incomes are too low to basically be able to make payments, while also having enough money for groceries and necessities of life.”

Borrowers who believe they meet the criteria above are encouraged to immediately sign up for SAVE at StudentAid.gov/SAVE.

In total, the Biden Administration has now approved debt cancellation for nearly 3.9 million student loan borrowers totaling almost $138 billion in debt relief.

Special Education Staffing, School Athletics Discussed In Education Committees

Wednesday was the first ever Special Education Day at the Capitol, and the House Education Committee took the opportunity to move House Bill 4902

The bill would first raise the pay of special education aides to match the pay of “Early Childhood Classroom Assistant Teachers” created by last year’s Third Grade Success Act. And then it would give special education aides a 5 percent raise on top of that. 

The bill also gives a 10 percent raise to Special Education Teachers in self-contained classrooms, where students with the most complex needs, who require the most support, are placed.

Another component of the bill that required board members who are certified in the subject area of a critical vacancy to go to the classroom and fill that position until someone is hired to do so was removed by amendment during the meeting.

Bill sponsor Del. Elliot Pritt, R-Fayette, said he agreed with the amendment because it left the most important action intact.

“We have people sitting in board offices at desks who are qualified to do jobs in the classroom, while we have critical vacancies in classrooms, across counties,” he said. “And all this would have done is tell them, hey, if there’s an empty critical vacancy, you have to be in the classroom till it’s filled. And you want to talk about lighting a fire under somebody’s rear end to aggressively try to find someone to fill those positions. You make them leave their office to go into that position for a while.”

The bill was voted to the House floor, but first with a recommendation to the House Finance Committee. The bill does not have a fiscal note at this time, and Del. Mike Pushkin, D-Kanawha, urged his colleagues on that committee to take HB 4902 seriously. He said it was one of the issues he hears most about from his constituents. 

“This is something that’s needed. It’s at a crisis level, the shortage that we have in our special education classrooms,” Pushkin said. “I certainly hope that they prioritize this bill. I know it’s late in the session for us to take this up, but better late than never. So those of you that are on the Finance Committee, get on it.”

House Education also discussed and advanced:

  • HB 4829, Relating employment of service personnel and removing the requirement for a high school diploma or general education development certificate.
  • HB 5425, Granting a waiver to fill certain professional educator positions of employment when no applicants have six or more years of experience.

In Senate Education

The Senate Education Committee met Thursday morning and took a rare action to reconsider an amended bill that they had recommended to the full Senate Tuesday.

Senate Bill 813 would allow students to participate in non-school competitive activities and remove restrictions on external teams as a condition for playing for a school, team or sport. 

Sen. Mike Oliverio, R-Monongalia, rescinded his amendment extending the bill’s provisions to coaches, allowing them to coach multiple teams. Speaking to the broader bill, he gave the example of a cheer squad that could not cheer for their school’s basketball team all season because their competitive team season had a slight overlap.

“I think the goal of this bill is to give opportunities to children, but also give flexibility to parents to be able to decide what activities they will allow their children to participate in which ones will drive them to the school or locations for,” Oliverio said. “I think there’s some good that can come from this bill.”

The unamended bill was once again recommended to the full Senate.

WVU Extends Certain Financial Application Deadlines

West Virginia University is extending multiple key deadlines for incoming students following delays at the federal level for the 2024-2025 Free Application for Federal Student Aid or FAFSA. 

WVU’s deadline for the financial aid FAFSA priority consideration is now April 1, moved back from March 1.

The U.S. Department of Education has been working to create a simplified version of the form, which unlocks both federal and state financial aid for students, for three years after bipartisan legislation was passed in 2021.

The new FAFSA was published at the end of last year on Dec. 31, 2023. However, the FAFSA is normally published in early October, and the new release was almost three months later than normal.

Other state colleges and universities across the country, including both the California and Pennsylvania state university systems, have also extended their deadlines for applicants.
