House Votes for W.Va. Medical Cannabis Act

The House of Delegates has passed a Senate bill that would legalize medical marijuana in the state. But the bill has seen a number of changes since the 28 to 6 vote last week in the upper chamber.

During a late night floor session Monday, delegates voted on a handful of amendments to Senate Bill 386, including a committee substitute that completely replaces the Senate’s version of the bill with one sponsored by House Judiciary Chairman John Shott of Mercer County.

Senate Bill 386 would now put the West Virginia Medical Cannabis Act under the control of the West Virginia Department of Public Health. It would create a 6 percent excise tax on marijuana and pushes the rollout date back one year to July 2019 instead of the Senate’s July 2018 implementation date.

The latest version of the bill does not allow distributors to sell forms of the drug that can be smoked or eaten, but does include prescription oils, pills, or patch versions and a form that can be vaped. Judiciary Chair Shott says the bill would allow patients to make their own baked goods using the oils.  Medical marijuana would also not be covered by Medicare or Medicaid.

Delegate Shott has called this version of the bill a cautious approach to a controversial issue.

Delegate Tom Fast, a Republican from Fayette County, spoke in opposition to the bill as it was put to a final vote Tuesday. He argued since it is still classified as an illegal drug by the federal government, states shouldn’t make their own rules about using medical marijuana without the Federal Drug Administration’s approval and guidance.

“We’re declaring that we are no longer a state under the law,” Fast said, “We’re just going to join 28 other states and say we’re not going to obey the law. That makes no sense to me. If 28 people are gonna jump off a bridge, are you gonna jump off the bridge with them? Are we a nation of laws or are we not? That is the decision that you are faced with today.”

Republican Charlotte Lane of Kanawha County, who introduced her own bill this session to legalize medical marijuana that was never taken up in a committee, says this bill is a step in the right direction.

“People might not be 100 percent happy with it, but folks, this is a lot further than we ever thought we would get this session,” Lane noted, “and we all know people who are sick that can benefit from this or might benefit from it. Now, yes you can talk about maybe we should wait for the Federal Drug Administration, well folks, if you’re dying, it doesn’t matter. So, if something can make you feel better and ease those last days, last weeks for the patient, and for the members, then we ought to pass it.”

Many supporters of the bill have said legalizing medicinal use of the drug could help veterans suffering from PTSD. But Delegate Roy Cooper, a Republican from Summers County argued the legislation will just add another substance to the list of drugs that are abused in the state.

“The veteran’s suicide issue can be answered by the paper in my hand. We’ve now prescribed to veterans ever how many’s on this page; Prozac, Zoloft, sinequan, Wellbutrin, Valium, Ambien, Xanax, morphine, fentanyl, codeine, Ultram, Percocet, Vicodin – veterans are getting these pills shoved in their hands at veterans hospitals all over the country in combination with each other. That’s where our suicide issue’s coming from with veterans,” Cooper explained, “Now, so we put another drug out there and say, okay, you can take that on top of all this other stuff and then go ahead and drink a little alcohol with that. It’s a deadly cocktail folks; a deadly cocktail.”

Delegate Gary Howell, a Republican from Mineral County, supported the bill.

“I’m not a doctor, and I don’t know all of the medical benefits; I don’t know all the medical downsides, but I do know that people in the end of life; it gives them hope;” Howell said, “they’ve tried many other things, it hasn’t worked. They know this won’t cure their problem, but it will make ‘em a little bit more comfortable, and if you’ve been with someone at the end of their life, you want them comfortable, and that’s why I support this bill.”

Judiciary Chair Shott pointed to a study from the American Medical Association, that argued there was “high quality evidence” medical marijuana has done a lot of good for sick and dying patients.

“So shouldn’t we give, based on studies like this, shouldn’t we give our physicians the authority to use that type of tool to help their patients? And that’s really what we’ve done, and we’ve instilled in this structure protections to be sure this is not abused and is used properly,” Shott explained, “and for that, ladies and gentlemen, I strongly urge that we give our physicians this tool, that we pass this bill and provide some relief for those who can benefit from it.”

After an hour of debate, Senate Bill 386 passed 76 to 24 and now heads back to the Senate for consideration. If the Senate approves the bill, the West Virginia Medical Cannabis Act will head to the governor for a signature, but if the Senate refuses the House changes, the bill will go to a conference committee.

Governor Jim Justice has said he could support medical marijuana in the state.

House Makes Changes to Medical Marijuana Bill

A bill to legalize medical marijuana will be put to a vote in the House of Delegates Tuesday. Over the weekend, a handful of delegates from both sides of the aisle met with attorneys to discuss potential amendments to the Senate bill that were discussed in a late night floor session Monday. The bill has now taken a much different form than when it was approved in the state Senate just last week.

After a procedural move last week that brought Senate Bill 386, or the Medical Cannabis Act, immediately to the House floor, bypassing the committee process, House leadership acted quickly, delaying further consideration of the bill to allow it to be studied by members and staff over the weekend.

As approved in the Senate, the bill would create a 17-member commission in the West Virginia Department of Health and Human Resources. That commission would oversee the program, creating rules for doctors, patients, growers and dispensers that would then be approved by the Legislature.

A doctor could prescribe marijuana for certain illnesses like post-traumatic stress disorder, chronic pain, or seizures. Patients with a prescription would also be able to grow up to two plants for personal use. The program would not begin until July 2018.

A handful of delegates, including Judiciary Chair John Shott, met Sunday to discuss some changes they’d like to see to the legislation. From that meeting, two committee substitutes were drafted both of which were taken up by the House Monday night. One was sponsored by Chairman Shott, the second by a bi-partisan group of delegates that include Jordan Hill, a Republican from Nicholas County.

“There was a bi-partisan group that were in favor of the motion the other day,” Hill said, “We had all, you know, gotten together, came up with an amendment on this.”

Hill’s version would have changed the title to “The Patient Freedom Act.” It called for the commission to be independent but still under the DHHR, and would implement a 6 percent sales and a 6 percent excise tax on marijuana. But that version was never taken up Monday evening after delegates voted 51 to 48 to adopt Shott’s version of the bill.

The Judiciary chairman’s version only includes the 6 percent excise tax and keeps the original title “The Medical Cannabis Act.” His bill puts the control of medical marijuana under the Department of Public Health and pushes the rollout date back one year to July 2019.

Shott’s version would not allow the product to be smoked or eaten – only allowing an oil, pill, or patch version of marijuana to be prescribed. However, the oil could be incorporated into a baked good, Shott says, but only if that baked good is made by the patient.

Shott says the bi-partisan group of lawmakers created an amended bill that was still too broad and he’s pushing his fellow lawmakers to back a more cautious approach to a medical marijuana program.

“We modeled our bill after the most recent states, which were Pennsylvania, Ohio, Minnesota, and New York,” Shott noted, “This is basically a very cautious approach that each of them have taken after studying what has happened in other states. You know, I think we need to help some of these folks that don’t get relief from other conventional ways.”

Delegate Mike Pushkin, a Democrat from Kanawha County and one of the sponsors of the committee substitute supported by Delegate Hill, argued on the floor Monday night  that Shott’s amendment is too restrictive and doesn’t do enough to help the West Virginians struggling with serious diseases that could be helped through access to the drug.

“Anybody else’s phone ringing off the hook today? They want us to vote for this bill, but they want the bill to actually do something; they want a medical cannabis bill. The first amendment doesn’t really do that. It’s not even a toe in the water,” Pushkin said.

Most of the other amendments to the bill adopted Monday night were technical in nature, fixing grammatical errors or incorrect references.

The chamber voted to allow a terminally ill cancer patient who has a valid prescription to cross state lines and bring back a medical marijuana product consistent with West Virginia’s program. Another requires the containers holding marijuana products to be child proof.

The amended version of the bill will be up for a final vote in the chamber Tuesday. It will have to return to the Senate before it can be considered by the governor.

Striking Workers Exempt from Benefits Under Bill

The West Virginia House of Delegates has passed a Senate bill that changes the eligibility for unemployment benefits for workers who go on strike.

Senate Bill 222 was taken up by the House during a Saturday floor session. The bill would make workers who have temporarily lost their jobs due to a strike ineligible for unemployment benefits from the state.

Workers who go on strike and are permanently replaced at their jobs or workers who are impacted by a lock out can still receive those benefits.

Del. Mike Caputo, D-Marion, who is an international vice president for the United Mine Workers of America, said during a floor speech the bill is unnecessary and a “poke in the eye” to labor unions.

“This is just, in my opinion, a very unfair piece of legislation to workers who in the event have to go on strike to use the tool of withholding their labor to get a fair and just contract,” Caputo said, “This system has worked for many, many years, I don’t know anybody in recent history that’s receiving unemployment benefits; I don’t even know anybody in recent history who’s been on strike in West Virginia; there so few and far between anymore.”

House Judiciary Chair John Shott, R-Mercer, argued the bill clarifies the provision in the law.

It passed the chamber 57 to 42 and now heads back to the Senate.

Medical Marijuana Bill Bypasses Committee Process in W.Va. House

A senate bill to legalize medical marijuana in the state is being fast-tracked through the West Virginia House of Delegates. Senate Bill 386, which passed out of the state Senate Wednesday night on a 28 to 6 vote, would create the West Virginia Medical Cannabis Act, legalizing medical marijuana in West Virginia.

The bill creates a 17-member commission in the West Virginia Department of Health and Human Resources to oversee the program and write rules for legislative approval. Certain illnesses like post-traumatic stress disorder, chronic pain, or seizures could constitute a doctor prescribing marijuana under the bill. Patients with a prescription would also be able to grow up to two plants for personal use. The medical cannabis program, however, wouldn’t begin until July 2018.

In an evening floor session Thursday, delegates took up the Senate message notifying the House of the passage of the bill.

Delegate Mike Folk, a Republican from Berkeley County, made a motion to have Senate Bill 386 bypass the committee process and be brought immediately to the floor on first reading.

Several delegates spoke in favor of the motion including Republican Charlotte Lane of Kanawha County, who criticized House leadership for being unwilling to run the bill.

“It has become clear to me that my bill and other bills are never going to see the light of day,” she said, “and for those of us who have sick friends who want medical marijuana to ease their suffering, this is our only chance. I don’t know about you, but I spent the afternoon listening to all of my phone messages, and these were from people saying support medical marijuana.”

Earlier in the session, Democrat Isaac Sponaugle of Pendleton County tried to amend another bill to remove marijuana from the list of Schedule I drugs in the state. Schedule I drugs are classified as illegal with no medicinal benefit and include drugs like heroin and cocaine.

Sponaugle explained his amendment had been the first step in the process to make marijuana legal to prescribe in the state, but that motion was defeated in the House, because delegates argued the proposal hadn’t been vetted in the committee process.

But Senate Bill 386, Sponaugle says, has been.

“This bill passed out of the Senate, 28 to 6. It was vetted in the Health committee over there; it was vetted in the Judiciary committee over there,” Sponaugle noted, “This body, several weeks ago, made an amendment to lower Schedule I to Schedule IV. You stuck with your leadership team, and how many of you all got beat up for voting red? You’re not going to get another vote on this if you don’t vote today; I’m just gonna tell ya. It’s going to get buried in these committees, and you’re gonna be on the board voting against medical marijuana twice.”

Delegate Joe Ellington chairs the House Health Committee, which would have likely been the first to see the bill in the chamber. He encouraged members to trust him to get the bill on his committee’s agenda.

“I am willing to put it on the committee. I’ll run it,” Ellington said, “I don’t think the Speaker’s going to have any objection to that. I promise I’ll put it on the committee agenda, so you know, it’s up to you if you want to go through the normal process. I’ve heard members from the other side won’t try to discharge bills before talk about how important the process was to go through the committee process. You know, we can decide if we’re gonna be hypocrites or not. I’m willing to put it through the committee process, and then we can go from that.”

House Judiciary Chair John Shott of Mercer County says not giving the bill time in committee would not be doing West Virginians any favors.

“We would have this bill on Second Reading tomorrow if this motion’s passed. Second Reading. It is now almost 7:00 p.m. How long do you have to prepare your amendments for tomorrow? How long do you have to even read this bill tonight and learn what’s in it? It is a complicated issue, and we need some time to do it right,” Shott explained.

Republican Delegate Mike Folk, who made the motion to bypass the committee process, commended the Senate’s work on the legislation.

“The most important thing you need to know about the bill, to allay any fears you might have, is the effective date for that bill is not even until July 2018, most of the stuff; sets up a commission to study so to develop the rules and regulations to address any concerns that anybody might have,” Folk said, “You can feel confident that there will be a structure in place in this bill.”

After an hour of debate, Folk’s motion passed 54 to 40, and the bill was read a first time on the floor. It will be on second reading Friday, and could see a final vote as early as Saturday.

House Bill to Review Criminal Penalties in W.Va.

House Bill 2966 would put together an independent panel and create the West Virginia Sentencing Commission.

It was taken up by the House Judiciary Committee Monday afternoon and is sponsored by House Speaker Tim Armstead.

The Sentencing Commission would look at all of the criminal penalties in state code and make recommendations to lawmakers for potential legislative changes.

That’s what House Judiciary Chair John Shott, of Mercer County, says is the commission’s main purpose.

“We’ve had many laws on the books for decades and some new laws, and during our discussions here in the House chamber, there have been concerns expressed about disproportionality between certain crimes and others,” Shott explained, “so this would be an effort to get someone to take a look at that and give us some suggestions on how to rewrite some of those.”

Shott says the commission would help create fair and uniform sentencing guidelines for West Virginia.

It would be made up of 14 members appointed by the House Speaker, Senate President, and the Governor. Commissioners would serve for two years and wouldn’t be paid for doing so.

The House Judiciary Committee also adopted amendments to the bill Monday. One would require the commission to place a special emphasis on the state’s drug laws, and appoint additional members – two attorneys appointed by the President of the state’s bar exam, and two counselors from the West Virginia Association of Alcoholism and Drug Abuse.

The bill was approved by the committee and now moves to the full House for its consideration.

Arrests vs. Treatment: Delegates Debate Drug Trafficking Bill

A bill increasing penalties for drug traffickers was largely the focus of the House floor session Friday. The bill is part of the House leadership’s plans to crack down on people selling drugs in West Virginia to curb the substance abuse epidemic.

House Bill 2648 would increase the penalties for trafficking or manufacturing a controlled substance while in the presence of a minor, making it a felony. The bill carries a penalty of a three year prison term without the ability to receive parole. 

The state Division of Corrections was asked to estimate the cost of the bill, but in the fiscal note, the division said they were unable to estimate how many new offenders would be sentenced. The division did say, however, that each new offender would cost the state about $28,000 per year.

The high cost was a concern for some lawmakers, including Delegate Larry Rowe, a Democrat from Kanawha County. Rowe says it’s unlikely most of the people convicted under the bill would be major drug traffickers, but addicts who need treatment.

“Every single day we’ve been in here, except the first few, we have had a bill to raise the penalties on a crime that already exists,” Rowe noted, “We’ve just got to stop doing it, and the economic argument’s very, very wise. We are spending a fortune on corrections; we are being ruined by the amounts of money we spend on corrections as crisis response, when we ought to be spending that same amount of money on prevention.”

Delegate Kelli Sobonya, a Republican from Cabell County, is one of the sponsors of the bill. She argued protecting children in the state, no matter the cost, is what’s important.

“We can talk about the cost of incarceration, but you know, we pass legislation and penalties for two reasons, to be used as a deterrent if it’s high enough, it can be a deterrent, hopefully, you know, people won’t do that behavior, but you know, most likely addicts, they’re gonna do it anyway, because they’re addicted. They make those bad decisions, because they do have an addiction,” Sobonya said, “But you know, for instances like this, I think, you know, that parents need to be held responsible for endangering their children.”

Delegate Mike Pushkin, a Democrat from Kanawha County, opposed the bill, because he says it does nothing to assist in the treatment of addiction, which is where lawmakers should be focused if they want to curb substance abuse in the state.

“These folks aren’t thinking in the long term. They’re not thinking about the penalty, they’re thinking about what’s right in front of ‘em,” Pushkin explained, “And, while I wish this bill, this legislation, would put an end to these stories that we’re hearing; I’m afraid that it will not, and what it will do is put a lot more people who could possibly benefit from treatment; it’s gonna give them longer sentences; not allow them to parole.”

Several lawmakers questioned House Judiciary Chair John Shott about hypothetical situations that could come up should the bill take effect. Shott says while those situations may deserve consideration, the law allows local prosecutors some discretion.

“There’s always a hypothetical that pulls at your heartstring in these cases,” Shott noted, “There’s always a hypothetical, but those hypotheticals are based on the absolute worst case scenario. They’re based on an assumption that our prosecutors don’t deserve our trust, they’re based on the assumption that we don’t have any trust or confidence in the legal system to do the right thing, or the common sense and good judgement of our jurors to see through our situation, and do the proper result, or in our judges.”

After over an hour of debate, House Bill 2648 passed 85 to 12 and now moves onto the Senate for consideration.
