West Virginia Reaches $161 Million Settlement With Teva, Allergan

The settlement is the largest yet between the state and opioid manufacturers.

Following a six-week trial in Kanawha Circuit Court, West Virginia settled with Teva and Allergan for $161.5 million.

That’s the largest opioid settlement to date in West Virginia. According to Attorney General Patrick Morrisey, it’s the largest per-capita settlement in the nation.

The settlement includes $27 million of Narcan, a lifesaving overdose treatment made by Teva.

In April, West Virginia reached a $99 million settlement with Johnson & Johnson. In total, the state has settled with opioid manufacturers for nearly $300 million.

“We took a lot of risk to do the absolute right thing,” Morrisey said, “and it’s paid off for West Virginia.”

The lawsuit against Teva and Allergan was filed in 2019 in Boone County Circuit Court.
