Shooting by Officer in W.Va. Investigated

Law enforcement officials are investigating the shooting of a West Virginia man by a police officer.

Sgt. B. D. Humphreys of the Kanawha County Sheriff’s Office says the early Wednesday shooting sent a 28-year-old South Charleston man to the hospital. He said Mickey Davis is in the intensive care unit.

Humphreys says in a news release the shooting occurred in Nitro after a police officer attempted to stop Davis, whose vehicle had only one operating headlight. He said Davis did not stop and a short chased followed.

Humphreys says Davis stopped but then attempted to hit the officer with his vehicle. He said the officer then fired several shots, striking the driver several times.

Humphrey said a passenger was not injured.

Nitro police asked the sheriff’s office to investigate.

Nitro Officer Who Killed Man Says He Had No Choice

A Nitro police officer who fatally shot a man says he had no other choice.

Sgt. T.A. Jarrell tells WSAZ-TV that 52-year-old David Lane Cooke of Nitro fired a gun at him as he approached the man. He says they then exchanged gunfire.

Jarrell says he was protecting not only himself but several bystanders.

The shooting occurred on Aug. 1 at a boat dock.

Jarrell says he was responding to a call about a domestic disturbance when he was told that the suspect had gone to the dock. He says Cooke was standing outside his vehicle when he arrived at the dock.

The Kanawha County Sheriff’s Office is investigating the shooting. The Nitro Police Department is conducting an internal investigation.

Sheriff: More Information Next Week on Police Shooting

The Monongalia County sheriff says more information will be released next week on the fatal police shooting of a Morgantown woman.

Christie Cathers was killed by police gunfire June 5. Two deputies have been on paid administrative leave since the shooting.

The Dominion Post said it has requested video taken by police and the 911 tapes of the incident. Police have refused, citing an investigation.

Investigators have said 45-year-old Cathers attempted to run down a deputy with her vehicle before she was shot. They had been pursuing Cathers after witnesses said she displayed a knife to some residents and demanded that a teenager get into her vehicle.

Sheriff Al Kisner said Friday his office and Mon County Prosecuting Attorney Marcia Ashdown will hold a joint press conference next week.

Man Shot by W.Va. Trooper After Aiming Gun at Officer

State police say a trooper shot and wounded a Nicholas County man after he aimed a gun at the officer.

Lt. Michael Baylous says the shooting occurred Wednesday at 64-year-old Floyd A. Graham’s residence in Muddlety.

Several troopers and members of a regional drug task force went to the residence to serve a search warrant. Baylous says Graham had a gun in his hand when officers encountered him in the residence.

Baylous says Graham refused to drop the gun and then aimed it at a trooper. The trooper shot Graham once in the chest.

After Graham was shot, Baylous says he fired the gun multiple times at the officers. He then was taken into custody and was taken to a Charleston hospital.

Baylous says Graham remains in stable condition.

Man Critically Wounded After Being Shot by Elkins Police

State police say officers shot a man in Elkins after he pointed a handgun at them.

 

State police say 25-year-old Preston L. Burrows was critically injured and was taken to Ruby Memorial Hospital in Morgantown.

 

The incident began around 3:30 a.m. Saturday when a resident called 911 and reported that a man was banging on his door and shouting that he would kill himself if the door wasn’t opened.

An Elkins officer encountered the man carrying a handgun near the residence. Two State Police troopers and another Elkins officer then arrived on the scene.

 

State Police First Sergeant G.L. Stalnaker says the man demanded that the officers shoot him, and became upset when they didn’t. He then pointed the gun at them.

Federal prosecutors plan to review evidence from a state investigation of the fatal shooting of a Virginia man by Martinsburg police.

U.S. Attorney William J. Ihlenfeld notified Berkeley County NAACP President Hubert J. Smith of the review in a letter sent last week. Smith read the letter at a Martinsburg City Council meeting on Tuesday.

The county NAACP asked Ihlenfeld in March to investigate the death of 50-year-old Wayne Arnold Jones of Stephens City, Virginia. An autopsy found that Jones was shot 23 times on March 13, 2013.

Police have said Jones, who was black, drew a knife after the officers stopped him as he was walking on a street. One officer was stabbed during a scuffle.

A Berkeley County grand jury declined in October 2013 to indict the five officers involved in the shooting.
