November 8, 1936: Darrell McGraw Born in Wyoming County

Darrell McGraw was born in Wyoming County on November 8, 1936. After graduating from Pineville High School, he earned degrees from Berea Academy and West Virginia University, where he served as student body president. He also served a stint in the army.

In the 1960s, he opened a private law practice and was a legal counsel to Governor Hulett Smith and the legislature. A staunch Democrat, McGraw was elected to the state Supreme Court in 1976, one of three liberals elected to the court that year. The outspoken justice was a lightning rod for conservative critics for court cases such as the 1978 Mandolidis decision, which expanded the rights of injured workers to sue employers.

McGraw was defeated for re-election as attorney general in 1988 but was elected state attorney general four years later. In his 20 years in that position, McGraw emphasized consumer protection and won important settlements with a direct-mail operator and against the tobacco industry.

Darrell McGraw was defeated for re-election in 2012 by Republican Patrick Morrissey. And in 2016, he was defeated in another bid for the state Supreme Court.

Outside Money in West Virginia High Court Race Nears $500K

Almost a half-million dollars in outside interest group money is influencing West Virginia’s five-way Supreme Court race through advertising.

Disclosures with the secretary of state show the Republican State Leadership Committee bought $269,200 in ads against Bill Wooton and Darrell McGraw, both former Democratic elected officials.

For the first time, the race is nonpartisan and will be decided during the May 10 primary.

Incumbent Justice Brent Benjamin, who was elected as a Republican in 2004 in a flurry of outside spending, called on the GOP group to withdraw the ads. Beth Walker has much of the GOP establishment’s support.

The West Virginia Chamber of Commerce bought $169,400 in ads supporting Walker. The West Virginia Business & Industry Council’s PAC bought $54,600 in ads backing her.

Wayne King, a Democrat, is also running.

Ex-Attorney General McGraw Files for Supreme Court Race

Former state Attorney General Darrell McGraw wants one of his old jobs back.

According to the West Virginia secretary of state’s website, the 79-year-old McGraw filed on Saturday to run for the state Supreme Court.

McGraw spent one term on the court from 1976-1988 and served five terms as attorney general. He lost the 2012 attorney general’s race as the Democratic incumbent to Republican Patrick Morrisey.

The Supreme Court election will be nonpartisan for the first time in 2016. The election will be held during the May primary.

Incumbent Justice Brent Benjamin is seeking re-election. Others who have filed for the race are Wayne King, Beth Walker and Bill Wooton.

McGraw’s brother, Warren McGraw, previously served on the Supreme Court.
